1. Definitions
For purposes of these Terms and Conditions:
- "Service" refers to senior care programs offered by rachaoes, including Peaceful Living Residence, Weekend and Holiday Companionship, and Personalized Long-Term Care Plans
- "User" or "You" refers to families, legal guardians, or residents enrolling in or inquiring about our services
- "We," "Us," or "Our" refers to rachaoes
- "Content" includes all information, text, images, and materials on our website
- "Agreement" refers to these Terms and Conditions along with any signed program enrollment documents
- "Property" refers to the rachaoes facility located at 51 Moo 6, Hua Hin, Prachuap Khiri Khan 77110, Thailand
2. Acceptance of Terms
By accessing our website, inquiring about our services, or enrolling in any program, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or website.
This agreement is formed when you:
- Submit an inquiry form through our website
- Sign an enrollment agreement for any program
- Visit our property for a tour or consultation
- Make payment for any service
You must be at least 18 years of age to enter into this agreement. If enrolling a resident, you must have legal authority to make decisions on their behalf.
3. Service Description
rachaoes provides the following senior care programs:
- Peaceful Living Residence: Full-time residential care with private rooms, communal meals, and access to garden grounds
- Weekend and Holiday Companionship: Weekend activities and holiday programming for independent seniors seeking social engagement
- Personalized Long-Term Care Plan: Customized care arrangements with named companions for stays of six months or longer
Services are provided at our coastal property in Hua Hin, Thailand. All programs are subject to availability and resident suitability assessment.
We reserve the right to modify program offerings, schedules, and activities based on operational needs, weather conditions, or unforeseen circumstances.
4. User Responsibilities
4.1 Accurate Information
You agree to provide accurate, complete, and current information regarding:
- Health conditions and preferences of the resident
- Emergency contact details
- Dietary requirements and restrictions
- Communication preferences
- Payment and billing information
4.2 Family Conduct
During visits to our property, families agree to:
- Respect quiet hours and other residents' privacy
- Follow property safety guidelines
- Communicate respectfully with staff and other families
- Notify staff of extended visits or meal participation in advance
4.3 Prohibited Activities
The following activities are prohibited:
- Bringing alcohol or controlled substances onto the property without prior authorization
- Removing residents from the property without proper notification to staff
- Sharing login credentials or access codes with unauthorized individuals
- Using our website or services for unlawful purposes
- Attempting to damage or interfere with property operations
5. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of rachaoes and protected by Thai and international copyright laws.
You are granted a limited, non-exclusive license to:
- View and access website content for personal, non-commercial purposes
- Print pages for family reference regarding our services
You may not:
- Reproduce, distribute, or modify our content without written permission
- Use our branding, logos, or materials for commercial purposes
- Create derivative works based on our website content
6. Payment Terms
6.1 Pricing and Fees
- Peaceful Living Residence: ฿17,500 per month
- Weekend and Holiday Companionship: ฿4,600 per month
- Personalized Long-Term Care Plan: ฿72,000 per month
Prices are in Thai Baht (THB) and subject to change with 30 days advance notice to enrolled families.
6.2 Payment Methods
We accept payment via bank transfer, cash, or credit card (subject to processing fees). Payments are due on the first day of each month for that month's services.
6.3 Refund Policy
For monthly programs, refunds are prorated based on unused days if notice is provided at least 14 days before the next billing cycle. No refunds are provided for voluntary absence or temporary family arrangements.
Personalized Long-Term Care Plans require 30 days notice for cancellation with prorated refund calculation.
7. Service-Specific Terms
7.1 Residence Programs
Full-time residence includes private room, three daily meals, access to grounds, and staff presence. Additional services such as specialized dietary preparation or external outings may incur extra charges.
7.2 Weekend Companionship
Program participation is flexible with no attendance requirements. Activities are scheduled Saturday and Sunday with holiday events announced monthly. Transportation to and from the property is the family's responsibility.
7.3 Long-Term Care Plans
Care plans are developed collaboratively with monthly review meetings. Named companions are assigned based on compatibility and availability. Plans are designed for minimum six-month commitments.
8. Disclaimers
Services are provided "as is" without warranties of any kind, express or implied. While we maintain trained staff and appropriate safety measures, we cannot guarantee specific outcomes or results from our programs.
rachaoes is not a medical facility. We do not provide medical treatment, diagnosis, or licensed nursing care. Families are responsible for arranging appropriate medical care for residents as needed.
Information on our website is for general guidance only and should not be considered professional advice regarding health, legal, or financial matters.
9. Limitation of Liability
To the maximum extent permitted by Thai law, rachaoes's liability is limited to the amount paid for services in the three months preceding the claim.
We are not liable for:
- Indirect, incidental, or consequential damages
- Personal property loss or damage (residents are encouraged to maintain appropriate insurance)
- Service interruptions due to force majeure events (natural disasters, pandemics, government actions)
- Third-party actions or decisions beyond our control
10. Indemnification
You agree to indemnify and hold rachaoes harmless from claims, damages, or expenses arising from:
- Your violation of these Terms and Conditions
- Inaccurate or incomplete information provided about the resident
- Actions taken by you or your family members while on the property
- Breach of any representation or warranty made in enrollment documents
11. Termination
11.1 Termination by Family
Families may terminate services with appropriate notice:
- Monthly residence programs: 14 days notice
- Weekend programs: No notice required
- Long-term care plans: 30 days notice
11.2 Termination by rachaoes
We reserve the right to terminate services if:
- Care needs exceed our scope of service
- Payment is more than 15 days overdue
- Family conduct violates these terms or disrupts property operations
- Resident safety or wellbeing requires alternative care arrangements
We will provide 30 days notice for termination except in cases of immediate safety concern.
11.3 Effects of Termination
Upon termination, all outstanding payments become immediately due. Personal belongings must be collected within 7 days. Care records will be provided to designated family members or transferred to new care providers as directed.
12. Dispute Resolution
12.1 Governing Law
These Terms and Conditions are governed by the laws of Thailand. Any disputes will be resolved in accordance with Thai law and under the jurisdiction of courts in Prachuap Khiri Khan, Thailand.
12.2 Informal Resolution
Before pursuing formal action, parties agree to attempt informal resolution through direct discussion with rachaoes management. We encourage families to communicate concerns promptly.
13. General Provisions
13.1 Entire Agreement
These Terms and Conditions, along with signed enrollment documents and our Privacy Policy, constitute the entire agreement between you and rachaoes.
13.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force and effect.
13.3 Waiver
Failure to enforce any provision does not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer your rights under this agreement without written consent. rachaoes may assign this agreement to a successor organization.

14. Changes to Terms
We may update these Terms and Conditions periodically. Significant changes will be communicated via email to enrolled families at least 30 days before taking effect. Continued use of services after changes take effect constitutes acceptance of the revised terms.
